1. Platform Role
The Carrier Hub Ltd operates as a technology marketplace that connects Shippers with Carriers. We are not a carrier, freight forwarder, or transport operator. We are not a party to any contract for the carriage of goods formed between Shippers and Carriers through the Platform.
2. Exclusions
To the fullest extent permitted by applicable law, The Carrier Hub Ltd excludes all liability for:
- Loss or damage to goods in transit
- Delay in collection or delivery
- Personal injury or property damage caused by a Carrier or Sub-Carrier
- The Carrier's failure to hold valid licences, insurance, or comply with road transport regulations
- Inaccurate information provided by Carriers or Shippers on the Platform
- Loss of profit, revenue, business, contracts, or anticipated savings
- Indirect, consequential, special, or punitive losses of any kind
- Business interruption or loss of data
- Any loss arising from your reliance on AI-generated price predictions, route suggestions, or carrier matching results
3. Cap on Liability
Where liability cannot be excluded, our total aggregate liability to you for any claims arising from or related to the Platform shall not exceed the greater of:
- The total fees paid by you to The Carrier Hub Ltd in the 12 months preceding the claim, or
- £500
4. Exceptions
Nothing in these Terms limits or excludes our liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any other liability that cannot be excluded or limited by law under the Consumer Rights Act 2015 or Unfair Contract Terms Act 1977
5. Indemnity
You agree to indemnify and hold harmless The Carrier Hub Ltd, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your breach of the Agreement, your use of the Platform, or any contract for carriage formed through the Platform.
6. Force Majeure
We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including acts of God, government actions, internet outages, or third-party service failures.
